Terms and Conditions of Membership

The Terms and Conditions of the Membership Program shall be binding on all members of the Auctions operated by World World Watch Auction Limited Company (hereinafter referred to as "the Club"). By registering as a member of the Club, the applicant agrees to be bound by the Terms and Conditions of the Club's Membership Program (including the terms and conditions in force from time to time).

Membership

1.1 Participants must join as a member in the name of a company or corporation by registering on the "Register Member" page of the Association's website and submitting the following documents for approval.

(a) the establishment of a company in the country where it is located, the registration or certificate of business operation of the corporation

(b) Company or corporate address

(d) information about the responsible person and his/her contact details

(e) Information of bidders and their contact details

(f) Bank accounts

(g) Annual membership fee of HK$1500

We will review the information and reply the result within 7 working days after receiving the submission.

1.2 Upon successful registration as a Member, you will be issued a set of Member ID and password. Membership accounts are not transferable. The use of a member's account means that he/she has read and agrees to accept the terms and conditions on this page.

1.3 Members may notify the Association by email or in writing of the termination of their membership or amendment of their membership information. The Association will reply and complete the updating of records within 7 working days after receiving the instruction.

1.4 We reserve the absolute right (with or without notice) to terminate the membership of any member for misbehavior, fraud, misuse of member's benefits, or failure to comply with the terms and conditions of the program and will not be liable for any loss or damage arising therefrom.

1.5 The Association reserves the absolute right to terminate the operation of the Association at any time without giving any reason therefor by giving reasonable notice wherever reasonably practicable and all rights of Members shall cease. The Association shall not be liable for any loss or damage arising therefrom.

Collection and Use of Members' Data

2.1 The information we collect about companies, corporations and individuals includes names, contact numbers and email addresses. Members voluntarily provide, agree and understand that the personal data provided to us will be kept in a confidential form and may be used for the following purposes.

(a) for the day-to-day operation of the Company, such as identity verification and record-keeping for the provision of membership services to you and the processing of membership information

(b) Conducting market research and analysis in relation to our auctions and services.

(c) to send out periodic notices of auction dates and product information regarding our latest business areas in the watch industry and the luxury goods sector

(d) Responding to Auction Results, Enquiries or Complaints

2.2 The Association undertakes that all members' information will be kept confidential and will not be sold or transferred to any third party for the purpose of direct marketing of its products or services, and will only be disclosed and transmitted to the following groups which are jointly operated with the Association and are under a duty of confidentiality.

(a) HONG KONG WATCH TRADE DEVELOPMENT COMPANY LIMITED

(b) OKURA HOLDINGS CO., LTD

(d) Auction site providers engaged by us

(e) any person to whom we are required by applicable laws, administrative systems or regulations to make disclosures or transfers.

We reserve the right to change the Terms of Use without prior notice and reserve the right of final decision on any disputes.

會員條款

本會員計劃條款及細則對由世界鐘錶拍賣有限公司運作之拍賣會(以下稱「本會」)之所有會員均有約束力。經登記成為本會會員，申請人即同意接受本會會員計劃條款及細則 (包括不時生效之條款) 約束。

1) 會籍

1.1參加必需以公司或法團名義加入會員，於本會網站上「登記會員」登記並提交以下文件作審批:

(a) 所在國家開設公司，法團的商業營運登記或證明書

(b) 公司或法團地址

(d) 負責人資料及其聯絡方式

(e) 參與競拍者資料及其聯絡方式

(f) 銀行帳戶

(g) 會員年費港幣$1500

本會將於收到交件後7個工作天內將審批資料並回覆結果。

1.2成功登記成為會員後將獲發一組會員帳號及密碼。會員帳號不能轉讓。且使用本會會員帳號即表示已閱讀及同意接受此頁條款及細則。

1.3會員可透過電郵或書面形式通知本會終止其會籍或修改其會員資料，本會將於收到指示後7個工作天內給予回覆及完成更新紀錄。

1.4行為不檢、詐騙、不當使用會員權益或未能遵從本會計劃條款及細則，本會保留絕對權利(不論是否發出通知)終止任何會員的會籍，且不會承擔因此而引起的損失或損害。

1.5本會保留絕對權利於任何時間，在合理可行的情況下，透過給予合理的通知，終止本會的運作而無須給予任何理由，會員之一切權利即告終止。本會將不會承擔因此而引起的損失或損害。

2) 會員資料的收集及用途

2.1本會收集到的公司，法團及個人資料包括姓名、聯絡電話、電郵地址。會員均屬自願向本會提供，同意及明白向本會提供的個人資料將以保密形式保存起來，並可用作下列用途:

(a) 為本公司之日常運作，如身份核證及紀錄為閣下提供會員服務，以及處理會員資料

(b) 進行本會拍賣及服務有關的市場調查及分析;

(d) 回覆拍賣結果，查詢或投訴

2.2本會承諾所有會員資料保密，絕不會被出售或轉移給第三者作其產品或服務之直銷用途，只會披露及傳送予與本會聯合營運及有保密責任之以下群組:

(a) HONG KONG WATCH TRADE DEVELOPMENT COMPANY LIMITED (b) JWA

(b) OKURA HOLDINGS CO., LTD

(d) 本會聘用之拍賣網站供應商

(e) 按適用法律、行政制度或規例要求，本會必須向其作出披露或轉移之任何人士。

本會保留更改使用條款的權利而無須另行通知，並保留任何爭議最終決定權。

Seller's Terms

Sellers are required to register as our members. Please refer to "Terms and Conditions of Membership" for details.

Consignment

1.1 Commission 1%

1.2 We conduct online auctions, which last for a few days. Sellers can deliver their lots to us 7 working days before the designated auction date.

1.3 Please make sure that all lots are in working condition before you consign them to us.

1.4 We reserve the right to determine the order of all lots in our catalogs.

1.5 If you do not want to be touched, please wrap the lot in protective film and inform our staff not to open it.

1.6 We will not disclose any bidding amount until the end of the auction period.

Collecting and picking up stray lots

2.1 The Seller can collect the payment within 5 working days after the auction, either in cash or by depositing it into the Seller's designated company bank account.

2.2 After the closing of the auction, if the bidding amount is greater than or equal to the reserve price, the auction is considered successful and the lot cannot be returned.

2.3 If there are no bids or bids are lower than the Seller's reserve price, the auction will be rejected and the Seller may cancel the auction within three working days after the end of the auction.

Retrieve the lot

2.4 After the auction has been rejected, the lot must be returned by post or transportation at the seller's expense, and we will not be liable for any loss or damage caused by delay, damage, loss or theft during the process.

3) Condition and description of the lot

3.1 You can download the Auction List Form from our website. Please label the lots with numbers and register them on the form in the order they are listed.

3.2 Describe in detail the brand model number and serial number of the watch. If any of them are ambiguous or missing, please indicate on the form.

3.3 Describe in detail the material, dial, function and accessories (box, certificate, etc.) of the watch. If there is any damage or lack of appearance, please note it on the form.

3.4 If the watch contains added or imitated parts or accessories, they must be described as such, and any part not specified will be regarded as original.

3.5 No consignments known to be stolen, forged or imitated

3.6 If a lot contains parts that are unknown or cannot be accurately described, the Seller may indicate "as is" if he/she wishes to avoid violating the return obligation.

"New" Definition

4.1 The certificate must be dated within three months from the date of auction.

4.2 The condition of the lot must be in line with market expectations and will be objectively assessed by us; if it does not meet these expectations, it will not be defined as "new".

"Antique Watch" Display

5.1 Where a watch is defined as an antique watch, the band must be removed to facilitate the display of the model and serial number.

5.2 Sellers must open the movement themselves or agree to let the Association operate it, take photos and upload them to the website, and then close the movement. Do not touch during the preview.

Refund of goods or negotiation of price adjustment

6.1 In reasonable circumstances, if a buyer applies for a refund of the purchase price, the application will be received by us within 10 working days after the collection of the lot by us (which may be extended by a few days by post) and will be forwarded to the seller immediately for reporting.

6.2 If an item is sent to the Official Repair Center for appraisal, we will contact the buyer to apply for an extension of time (normally one month), and we will continue to contact the buyer to decide on further extensions depending on the situation.

6.3 The seller should know and agree that the buyer has the right to refund the purchase price or negotiate a price adjustment within the above deadline.

6.4 If the following conditions are not specified by the Seller or are not in accordance with the description, the Buyer may request the Seller for a refund of the purchase price or negotiate an adjustment of the price through the Association.

(a) core damage

(b) the movement number does not match with that of the original manufacturer at the time of manufacture and a replacement certificate cannot be issued

(d) the model number or serial number is seriously ambiguous or missing

(e) Stolen goods (subject to a law enforcement agency's order or certifying instrument)

(f) Counterfeits, imitations (movements)

7. Disputes between buyer and seller

7.1 We will be fair and neutral in facilitating communication between the parties and resolving disputes effectively.

7.2 We will not be obliged to bear any debts or liabilities caused by disputes between the buyer and seller.

7.3 In the event that an item is deemed to be a counterfeit, imitation or stolen item and is seized by a government enforcement agency or the brand's official repair center, the Seller will be required to refund the full amount of the purchase price.

寄售拍品

1.1佣金1%

1.2本會經營網上拍賣，拍賣為期數天，賣家可於指定拍賣日期前7個工作天把拍品送往本會

1.3請確保所有拍品寄售本會前皆為正常可運作狀態

1.4本會有權決定拍品於本會目錄中的所有位置順序

1.5如拍品不想被觸碰，請自行使用保護膜加以包裹，並告知本會職員不得拆封

1.6為期數天拍賣結束前，本會將不會透露任何競拍出價金額

2)收款及取回流拍品

2.1賣家可於拍賣結束後五個工作天內完成收款，現金或存入賣家指定的公司銀行戶口

2.2拍賣截止後，競拍金額大於或等於底價，視為競拍成功，拍品不能歸還

2.3未有出價或低於賣家底價，均屬流拍，賣家可於拍賣結束後三個工作天內

取回拍品

2.4流拍後，拍賣品需郵寄或押運歸還，費用由賣家支付，過程中延誤，損毀，掉失或遭盜竊，本會將不會承擔因此而引起的損失或損害。

3)拍品狀態及描述

3.1可於本會網站下載拍賣品清單表格，請把拍賣品加以號碼標籤，並以順序登記於表格上

3.2詳細描寫手錶品牌型號和編號，其中如有模糊或缺失，請於表格上註明

3.3詳細描寫手錶材質，面盤，功能及附屬品(錶盒，証書等)，如外觀上有任何損毀或缺失，請於表格上註明

3.4如手錶含有後加或仿製的部份或配件，需如實描寫，未有特別註明的部份，一律視為原裝

3.5不得寄售已知為失竊品，偽品或仿製品

3.6如拍品含有未知或不能準確描述的部份，賣家欲避免觸犯退還責任，可註明「現狀」

4) 「全新」定義

4.1證書出廠或保養日期須在拍賣日當天三個月內

4.2拍品狀態必須符合市場預期，本會亦會作出客觀評估，如未能達致預期，不能定義為「全新」

5) 「古董錶」展示

5.1凡定義為古董錶必須拆除錶帶以方便展示型號及編號

5.2賣家須自行打開機芯，或同意本會代為操作，拍照並上傳到網站，及後關閉機芯，預展時不能觸碰

6) 退還貨款或協商調整價錢

6.1在合理情況下，如買家申請退還貨款，由本會提取拍品後十個工作天內(經郵寄可能延長數天)，本會便會收到申請並立即轉告賣家報備

6.2如拍品遭送檢品牌官方維修中心鑑定，本會聯絡作延期申請(一般延期為一個月)及後本會將與買家持續聯繫,視情況以定再作延期

6.3賣家需知悉並同意以上限期內，買家有退還貨款或協商調整價錢要求的權利

6.4 下列狀態如賣家沒有註明或與描述不符，買家可經由本會向賣家要求退還貨款或協商調整價錢

(a) 機芯損壞

(b) 機芯號碼與原廠出產時不符，未能獲發後補證書

(d) 型號或編號模嚴重糊或缺失

(e) 失竊品(需執法機關判令或證明文書)

(f) 偽品，仿製品(機芯)

7) 買賣雙方糾紛

7.1本會將公正及中立的態度促成雙方溝通並有效地解決糾紛

7.2買賣雙方因糾紛而造成的債權或債務，本會將沒有義務承擔

7.3如拍品被確認為偽品，仿製品失竊品而遭政府執法機關或品牌官方維修中心扣押，賣方需退回全數貨款

Buyer's Terms and Conditions

Buyers need to register as our members. Please refer to "Terms and Conditions of Membership" for details.

1) Auctioning Methods

1.1 Commission of 3%

1.2 We conduct online auctions for a few days. Buyers can browse all the pictures and descriptions of the lots on our website and bid for them.

1.3 Confidential bidding is used, the bidding amount can be modified on the website during the auction, and it is not possible to view the amount of other bidders.

1.4 At the end of the auction period, all bids will be counted and the highest bidder will be successful.

1.5 All bids that are substantially higher than the market value of the lot, without reasonable explanation, will be based on the amount at the close of the auction, and the Buyer must complete payment in that amount.

2) Payment and Collection

2.1 The Buyer shall complete the payment within 5 working days after the auction, either in cash or by depositing the payment into the bank account designated by us.

2.2 If the buyer is out of contact or refuses to make payment without a valid reason within the time limit, the buyer will be deemed to have given up and the membership will be canceled.

2.3 You can pick up the product in person, or contact us to send it by post or escort at the buyer's expense.

2.4 We shall not be liable for any loss or damage arising from delay, damage, loss or theft in the course of mailing or transportation.

3) Preview

3.1 During the auction period, we will hold a preview exhibition to display all the lots on the website.

3.2 Preview is for members only.

4) Condition of the lot and online description

4.1 The pictures and descriptions of the lots on the website will be provided by the seller, and we will also provide assistance in objective evaluation and annotation, and any unannotated parts should be evaluated by the buyers themselves.

4.2 The following items are in "evaluable condition" and are subject to the buyer's experience and responsibility, and may not be returned to the buyer for any of the following reasons

(a)Indicated all the sketches or destroy on the watch case, strap, crown, bezel and bracelet

(b) Damage and missing screws visible on the caseback, strap or exterior

(d) time speed error, including automatic, manual winding and quartz

(e) Replacement leather straps and buckles

(f) Watch accessories (watch box, certificate, etc.)

(g) Seller-specified additions or imitations (e.g. bezel, dial, etc.)

(h) Watches marked by the seller as "as is" are subject to the buyer's own evaluation and will not be returned to the buyer.

5) Return the item or negotiate price adjustments

5.1 In reasonable circumstances, if you wish to apply for a refund of the auction item, you must contact the Association within ten working days after collecting the auction item.

5.2 If the sample is sent to the official repair center of the brand for appraisal, it is necessary to contact our association to apply for an extension (usually one month) and then the association will facilitate continued communication between the buyer and seller, and further extensions will be considered as needed.

5.3 The following conditions, if not specified by the seller or do not match the description, can be requested by the Association to return the auction item to the seller or negotiate price adjustments.

(a) Movement damage

(b) The movement number does not match the one produced by the original factory, and a supplementary certificate cannot be obtained

(d) Model or number severely blurred or missing

(e) Stolen items (require a court order or proof document from law enforcement agencies)

(f) Counterfeit, imitation products (movement)

6) Disputes between buyer and seller

6.1 We will be fair and neutral in facilitating communication between the parties and resolving disputes effectively.

6.2 We will not be obliged to bear any debts or liabilities caused by disputes between the buyer and seller.

6.3 In the event that an item is deemed to be a counterfeit, imitation or stolen item and is seized by a government enforcement agency or the brand's official repair center, the Seller will be required to refund the full amount of the purchase price.

1) 競拍方式

1.2本會經營網上拍賣，拍賣為期數天，買家可於本會網站上瀏覽所有拍品圖片及資料描述並競標出價

1.3採用保密競拍出價，拍賣其間可於網站上修改出價金額，無法觀看其他競拍者金額

1.4為期數天拍賣結束後，統計所有競拍出價金額，金額最高者將競拍成功

1.5一切大幅度高於拍品市場價值的競拍出價，如未有合理解釋，則以截止時金額為準，買家必須以該金額完成付款

2) 付款及取貨

2.1買家需於拍賣結束後五個工作天內完成付款，現金或存入本會指定的銀行戶口，

2.2如限期內買家失聯，或未有合理原因拒絕付款，則視作放棄並取消會員資格

2.3可親臨本會提取商品，或與本會聯絡代為郵寄或押運，費用由買家支付

2.4郵寄或押運過程中延誤，損毀，掉失或遭盜竊，本會將不會承擔因此而引起的損失或損害。

3) 預展

3.1拍賣期間本會將舉辦預展，展示所有網站上的拍品

3.2預展只供會員參與

4) 拍品狀態及網上描述

4.1網站上拍品圖片及描述，除賣家提供外，本會亦會提供協助，客觀評估並加以註明，一切未有註明的部份，需買家自行評估

4.2以下為「外觀可評估的狀態」，由買家經驗判斷及自行承擔責任，拍品成交後不得以下列理由作退回拍品要求

(a) 錶殼，錶帶，錶冠及外圈的磨損痕跡

(b) 底蓋，錶帶或外部所見螺絲的損壞及缺失

(d) 時間快慢誤差，包括自動，手動上鏈及石英

(e) 代用皮帶及錶扣

(f) 手錶附屬品(錶盒，証書等)

(g) 賣家特別註明後加或仿製部份(例如錶圈，面盤等)

(h) 賣家特別註明「現狀」之手錶，需買家自行評估，絕不退回拍品

5) 退回拍品或協商調整價錢

5.1在合理情況下，欲申請退回拍品，需在提取拍品後十個工作天內聯絡本會

5.2如送檢品牌官方維修中心鑑定，需與本會聯絡作延期申請(一般延期為一個月)及後經由本會促成買賣雙方持續聯繫,視情況以定再作延期

5.3下列狀態如賣家沒有註明或與描述不符，可經由本會向賣家提出退回拍品或協商調整價錢要求

(a) 機芯損壞

(b) 機芯號碼與原廠出產時不符，未能獲發後補證書

(d) 型號或編號嚴重模糊或缺失
